What You Should Know About the Colorado Parole Process
Parole is a form of early release from prison. In Colorado, a person may be granted parole, and as a general rule, parole comes with conditions. An individual must meet all of the requirements of their parole and a violation could result in the revocation of their parole. There are three different entities involved in the parole process in our state: 1) The Colorado Department of Corrections, 2) The Colorado Parole Board, and 3) The Colorado Division of Adult Parole Services. Each of these entities has its own responsibilities in the parole process.
We Handle All Aspects of the Parole Process and Parole Violations
Our criminal defense law firm helps clients with all aspects of the parole process. Most often, this starts with pre-parole procedures. Typically, a comprehensive parole plan must be developed before the date of an inmate’s actual hearing before the Colorado Parole Board. The Parole Board handles four different types of parole hearings. These include:
- Parole applications interviews;
- Full parole boards reviews;
- Parole rescission hearings; and
- Parole revocation hearings.
You need to be properly prepared for your specific parole hearing and our firm can help you with that. Whether you are making your initial application for parole and you need help creating a comprehensive plan of action to put yourself in the best position for an early, conditional release or you are facing allegations of a parole violation, it is essential that you have an experienced Colorado parole hearing lawyer on your side.
How Can I Obtain a Copy of the Audio of My Hearing?
Courts do not provide written transcripts of hearings or proceedings but you can request a copy of the audio of your hearing. For more information on how to request the audio, refer to pages 18-20 in the OAC Policy 15. If you need any assistance with this request, feel free to work with your attorney to obtain this information.
I Cannot Attend the Parole Board Hearing at the Facility. Can I Write a Letter of Support for the Offender Instead?
Yes. It is quite common for people to write letters of support for an offender. It is important to be as organized, detailed, and honest in your writing. Typically, a letter of support will include the following:
- An introduction about yourself and your relationship with the offender.
- Reasoning as to why you feel/believe the offender will not or is unlikely to re-offend or violate any parole guidelines.
- How you will support the offender in their rehabilitation process(es).
You can provide this letter to the attorney representing the offender to bring to the parole board hearing.
What is a Parole Rescission Hearing and How Does it Differ From a Parole Revocation Hearing?
A rescission hearing is conducted before a Colorado State Board of Parole member to help determine if the decision to grant parole should be rescinded prior to them being released from prison. This differs from a revocation in that a revocation hearing occurs after an inmate has been released and is held to determine whether or not the individual should be returned to prison.
Can Parole Officers Arrest a Parolee?
There are a few things parole officers can do if they feel the conditions of one’s parole have been violated.
- They can issue a summons to have the potential violation reviewed and pursue a parole revocation. If the parolee does not appear for this hearing, they may be arrested and found in violation of their parole for failing to appear at the hearing.
- They can request a warrant for a parolee’s arrest issued by the board for violating parole conditions.
Were you or someone you know arrested while on parole by a community parole officer or other law enforcement officer? You may not know what conditions of the parole were violated and need help defending your side of the story. Working with our Greeley parole hearing lawyer can help ensure your parole remains intact.
